By accessing or using ShopMagic ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Platform.

2. Description of Service

ShopMagic is a subscription-based e-commerce automation platform that provides tools for Shopify store owners to manage their dropshipping business, including product sourcing, order fulfillment, marketing automation, and analytics.

3. User Accounts

• You must be at least 18 years old to use this Platform.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must provide accurate, current, and complete information during registration.
• You must notify us immediately of any unauthorized use of your account.

4. Subscription Plans & Billing

• Starter Plan: $29/month - 1 store, 100 products, basic features
• Pro Plan: $79/month - 3 stores, 1,000 products, advanced features
• Elite Plan: $199/month - Unlimited stores and products, full automation
• All plans are billed monthly or annually in advance.
• Prices are subject to change with 30 days notice.
• You authorize us to charge your payment method for recurring subscription fees.

5. Cancellation & Refunds

• You may cancel your subscription at any time from your account settings.
• Cancellation takes effect at the end of the current billing period.
• We offer a 14-day money-back guarantee for new subscribers.
• Refunds are processed within 5-10 business days.
• No refunds are provided for partial months or unused features.

6. Acceptable Use

You agree NOT to:

• Use the Platform for any illegal purpose or in violation of any laws
• Sell counterfeit, stolen, or prohibited products through our Platform
• Interfere with or disrupt the Platform or servers
• Attempt to gain unauthorized access to any part of the Platform
• Use automated systems to access the Platform without permission
• Transmit viruses, malware, or other malicious code
• Harass, abuse, or harm other users
• Violate intellectual property rights of others

7. Third-Party Integrations

Our Platform integrates with third-party services including Shopify, Stripe, Meta, TikTok, Google, CJdropshipping, and AliExpress. Your use of these integrations is subject to their respective terms of service. We are not responsible for the availability, accuracy, or content of third-party services.

8. Intellectual Property

The Platform and its original content, features, and functionality are owned by ShopMagic and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT GUARANTEE ANY SPECIFIC BUSINESS RESULTS FROM USING OUR PLATFORM.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHOPMAGIC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.

11. Indemnification

You agree to indemnify and hold harmless ShopMagic, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform or violation of these Terms.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Platform will cease immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on this page. Your continued use of the Platform after changes constitutes acceptance of the new Terms.
